Provide Your Comment On Impeachment Allegations – CJ To Special Prosecutor
In a recent development, the Lady Chief Justice, Gertrude Sackey Torkornoo, has directed Special Prosecutor Kissi Agyabeng to provide comment on the matters raised in a petition seeking his impeachment.

The petition, filed by Martin Amidu, former Special Prosecutor, alleges various breaches of procurement law, abuse of power, and violations of citizens’ rights.
According to Article 146 of the Constitution, the Chief Justice is responsible for deciding whether there is prima facie evidence to establish a committee for Mr. Agyabeng’s impeachment.
The Chief Justice’s letter, dated May 16, 2024, indicates that Mr. Agyabeng’s comment on the issues raised will enable the Chief Justice to determine if a prima facie case has been made out.
The letter states: “This is to forward to you a copy of the petition dated 30th April 2024 sent to the Office of the President which was forwarded to the Office of the Honourable Lady Chief Justice on 6th May 2024.
Kindly provide your comment to the matters raised to enable the Honourable Chief Justice to determine if a prima facie case has been made out.”
Martin Amidu’s petition, anchored on Section 15 of the Special Prosecutor’s Act, 2017, Act 959, which focuses on procurement breaches, alleges that Mr. Agyabeng has breached procurement laws in the purchase of vehicles for the Office of the Special Prosecutor.
The former Special Prosecutor also alleged abuses involving judges and the administration of justice.
The petition further alleges that Mr. Agyabeng has abused his powers by arresting individuals such as Cecilia Dapaah and Prof. Frimpong Boateng, violating their rights.
He also claimed that Mr. Agyabeng requested appointment letters and salary details of all OSP staff to be put on a pen drive for him, which he believes is a violation of the right to information.
Mr. Amidu also alleged that by arresting individuals such as Cecilia Dapaah and Prof. Frimpong Boateng, the Special Prosecutor abused their rights.
He also claimed allegations of a violation of the right to information when Mr Agyabeng requested appointment letters and salary details of all OSP staff to be put on a pen drive for him, as well as issues with the appointment of personnel to the office.
This latest development has sparked comparisons with the impeachment process of Charlotte Osei, former Chairperson of the Electoral Commission.
The process began with a petition from Martin Amidu, who resigned as Special Prosecutor after accusing President Akufo-Addo of corruption and interference in the work of the Special Prosecutor.
As the Chief Justice continues to deliberate on the matter, it remains to be seen whether Special Prosecutor, Mr. Agyabeng will comment to the allegations made against him and what implications this may have for his tenure as Special Prosecutor.
