Judge’s Advice snubbed ; AG Not Recuse from Ambulance Case
AG snubs judge’s advice, vows to prosecute ambulance case himself
The Attorney General (AG), Godfred Yeboah Dame, has announced that he will not recuse himself from the ongoing ambulance procurement case, despite the advice of the presiding High Court Judge, Justice Afia Serwah Asare-Botwe.
The case involves the Minority Leader, Dr. Cassiel Ato Forson, and a businessman, Richard Jakpa, who are standing trial for allegedly causing financial loss of €2.37 million to the state.
In a ruling on four applications filed by the accused, Justice Asare-Botwe advised that the AG’s decision to step aside would ensure that the judicial process was protected and gain public confidence.
She emphasized that it would also prevent any perception that cases can be influenced outside of the courtroom.

However, Godfred Dame has rejected this advice, stating that the judge had not given such an order and that he will continue to conduct the trial.
“I’m conducting the matter, I’m still conducting the trial,” Godfred Dame said during a press conference after the proceedings.
The AG expressed his satisfaction with the verdict given by the judge, which dismissed all five applications filed by the accused.
“The most important thing today is that all the applications filed by applicants have been dismissed.
All the five applications have failed and in reaction to this, I will say that this clearly shows that a group of people in this country who ride on manipulations of facts, distortions and deceptions are seeking to mislead the public,” Godfred Dame said.
“Today, they have been exposed,” he added.
The Minority Leader and his co-accused had argued that the AG’s involvement in the case would create a conflict of interest, given his role as a prosecutor and a government official.
However, Godfred Dame has maintained that his decision to continue with the case is justified.
The ambulance procurement case is one of several high-profile corruption cases currently being investigated in Ghana.
The Attorney General’s decision to proceed with the case is likely to have significant implications for the prosecution and the reputation of the government.
If found guilty, Dr. Forson and Richard Jakpa could face serious consequences, including imprisonment and fines.
The case will be closely watched by the public and will likely have a significant impact on Ghana’s anti-corruption efforts.
