Supreme court declares payment of wages to spouses of President, VP unconstitutional

In landmark rulings, the Supreme Court of Ghana has deemed the payment of salaries or wages to the spouses of the President and Vice President unconstitutional.

This conclusion came through two judgments involving separate lawsuits filed by prominent political figures, Rockson Nelson Dafeamekpor, a Member of Parliament for South Dayi, and Kwame Baffoe Abronye, the Bono Regional Chairman of the New Patriotic Party (NPP).

These legal actions were prompted by a national debate sparked by the presidential emolument committee’s proposal to pay official wages and emoluments to the First and Second Ladies of the country.

The contentious nature of these recommendations led to public outcry and subsequent legal scrutiny.

Rockson Nelson Dafeamekpor’s legal challenge questioned the authority of the emoluments committee to even suggest or approve any form of salary or emolument for the presidential spouses.

Conversely, Kwame Baffoe Abronye’s lawsuit focused on challenging the constitutionality of Parliament’s approval of such salaries, arguing that it violated Article 71 of the 1992 constitution.

The Supreme Court, ruling unanimously in both cases, affirmed that the approvals and subsequent disbursements of salaries and other emoluments to the First and Second Ladies were unconstitutional.

This decision marks a significant moment in the governance of public funds and compensation of public figures, setting a precedent for how similar cases might be handled in the future.

The rulings underscore the importance of adhering to constitutional provisions and the need for clarity and transparency in governmental financial decisions.
