Special Prosecutor Facing Impeachment
President Nana Akufo-Addo has forwarded a petition seeking to remove Special Prosecutor, Kissi Agyabeng, to the Chief Justice.
The petition was sent by former Special Prosecutor, Martin Amidu, on April 30, 2024, and conveyed to Justice Gertrude Torkonoo on May 6, 2024.
The petition alleges several breaches of protocol and abuse of power by Mr. Agyabeng, including procurement breaches in the purchase of vehicles for the Office of the Special Prosecutor (OSP).
It also accuses him of abusing judges and the administration of justice, as well as violating citizens’ rights through arrests and detentions.
Furthermore, Mr. Amidu claims that the Special Prosecutor has violated the right to information by requesting appointment letters and salary details of all OSP staff to be put on a pen drive for him.

Additionally, he alleges that there have been improper appointments of personnel to the office.
This move comes after Mr. Agyabeng held a press conference in which he alleged that judges had conspired against him.
The former Attorney General and Minister for Justice, Martin Amidu, has responded by accusing Mr. Agyabeng of abusing judges and bringing the Judiciary into disrepute.
The Chief Justice is now in the process of deciding whether there is a prima facie case to establish a committee for Mr. Agyabeng’s impeachment.
This process is governed by Article 146 of the Constitution, which requires the Chief Justice to investigate allegations of misconduct against the Special Prosecutor.
The recent developments have raised questions about the independence of the Special Prosecutor and the integrity of the Office.
It remains to be seen how this situation will unfold and what implications it will have for the Office and the country as a whole.
Reactions from Stakeholders
The news has sparked a heated debate among stakeholders, with some calling for Mr. Agyabeng’s removal while others are defending his actions.
A senior lawyer, who wished to remain anonymous, stated that “Mr. Agyabeng’s conduct has been questionable from the start, and it’s about time someone took action to address these issues.”
On the other hand, a spokesperson for the Judicial Service, said that “the allegations made by Mr. Agyabeng are baseless and an attempt to intimidate the judiciary.”
What Follows?
The Chief Justice is expected to announce her decision soon, which will determine whether or not a committee will be established to investigate Mr. Agyabeng’s conduct.
